Image Submission and License Agreement

This agreement is between The Vanilla Issue (“we” or “us”) and you (the person submitting images). By sending us images — by email, through a form on our site, or any other way we invite — you agree to these terms.

1. Permission to use your images

You keep full ownership of your images. You give us a free, non-exclusive, worldwide licence to use them as described in this agreement.

That means we can post, share, resize, crop, edit, or add our logo or text to your images for our website, social media, articles, promotions and other marketing for The Vanilla Issue. We may pass these rights on to the platforms and service providers we use to publish your images, such as Instagram.

To the extent the law allows, you consent to us doing things with your images that would otherwise affect your moral rights as a creator — such as cropping them or adding our logo or text. We will not change your images in a way that could harm your reputation.

2. How we can use them

• We can use your images for articles, social media, promotions and other marketing.
• Because the licence is non-exclusive, you can still use your images anywhere else or sell them to others.

3. What you confirm

By submitting images, you confirm that:

• you own the images or have full permission to submit them
• your images do not break anyone else’s rights, such as copyright, trade mark or privacy rights
• if someone else (for example a photographer, model, stylist or make-up artist) owns rights in the image or appears in it, you have their permission for us to use it as described above, including adding our logo or text
• if you later sell or transfer the copyright, the new owner cannot revoke this licence or take action against The Vanilla Issue for uses already allowed under this agreement

4. If someone makes a claim

If anyone makes a legal claim against us because of your images, you are responsible for covering our costs and protecting us from harm.

5. Credits

When you send images, give us the credits to use (for example designer and photographer names). We will use the credits you provide unless you tell us not to.

6. How long we can use them

We can use your images for as long as the feature stays published. If you ask us to stop using them, we will remove them from our own website and social media accounts within a reasonable time. Copies already shared by others, or held by search engines, may remain for a time. We may keep your images in our private archives for record-keeping.

If anything in this agreement differs from our Terms of Use for the same images, this agreement applies.

7. Governing law

This agreement is governed by the laws of Queensland, Australia.

8. How this sits with our Terms

This agreement, together with our Terms of Use, covers how we use images you submit. It replaces any earlier discussions or agreements about these image submissions. If this agreement and the Terms ever differ for the same images, this agreement applies.

9. Your confirmation

By submitting your images you confirm that you understand and accept these terms.
